Collision With Uninsured Driver
[WA state] Almost a month ago I was rear ended by a kid driving home his first car while his mom followed behind him in a second vehicle, on their way home. I got drivers licenses from both and insurance info from the mom. We were about three blocks away from the address, and his name was also on insurance info. They were apologetic and assumed responsibility. I checked with my insurance to see if I 100% had to call the police and report the accident and they confirmed without serious injury or damage and with the information I collected it was ok not to. I really didn’t want to call the cops either, so I didn’t.
I immediately filed an insurance claim under their policy. I haven’t heard anything for almost a month until I called today to ask for an update. The agent told me they’ve been trying to reach the policy holder but been unable to contact them and get a statement from them regarding the accident. Additionally the new car was not insured and that the kid that hit me is Jr., while the policy holder is Sr., and the child was not listed on the policy. They still need to collect the statement, but at this time it was extremely unlikely that the damage would be covered. Am I totally screwed here? Everything I’ve read with the state says I need to report the collision within 4 days or have an incident report number to get any help collecting from uninsured drivers.
The collision shredded a tire, destroyed a leaf spring, damaged exhaust, so I figure I’m minimally $1k in damage without repairing any body work.. I cannot afford that right now. Luckily I have a take home company van, but I’m broke and have no personal vehicle until I can get it fixed.
