[ca] Potentially Lying About Existance Of Evidence After Subpoena

Card image cap

Location: California

I have a pending small claims suit where footage from my apartment complex is a key part of evidence for it. My complex refused to provide the footage and so I have subpoena'd my apartment complex. However they are claiming that there is no footage because of a power outage.

Is there any way for me to compel them to produce it (or at least prove it doesn't exist) or hold them in contempt?

I have strong reason that they are lying as this is the same excuse they gave when one of their own employees was caught stealing one of my posessions and power outages do not magically remove existing footage. When I served them the subpoena they initially stated that they had looked at the footage and did not see anything relevant and therefore wouldn't provide any footage. Only after I told them that it's up to the judge to determine relevancy did they concede to looking into providing the footage. I also walked by their DVR the day before they made that statement and saw some technician reviewing footage.

Tldr: apartment complex possibly lying they don't have footage after being subpoena'd. Anything I can do?
