Can My Residency Program Rescind My Admission Because I’m Pregnant And Due In The Program’s First Couple Weeks?
I just Matched into my dream residency program. A week before Match Day, I learned that I’m pregnant and will be due 2 weeks into the program. I feel so lost and I don’t know what my rights are. I have so many questions and nobody that can help me - student legal services refused because it’s a conflict of interest, and my state‘s legal aid program can‘t help because it’s not a legal case. Can somebody please share some insight with me?
1) Can they rescind my admission because I will miss a few of those first weeks of training? These days truly teach you the foundations before you can start seeing patients, so I know it’s extremely important.
2) To what extend are they required to make accommodations for me? Is creating an altered schedule considered an “undue hardship” for them that would prevent me from being protected legally?
3) At what point am I legally required to inform them of my pregnancy? I am only in the first trimester.
4) What is the minimum maternity leave they’re allowed to give me? I’m sure that’s probably what I will have to take.
Thank you so much to anyone who has any info for me! Both of these things are supposed to be some of the happiest moments of my life, but I’m really struggling with the fact that I might not be able to have both.
