Employer Missed Payday. What Should I Do
Hi everyone, I’m a W2 contractor in Texas working through a consulting company. Today is my scheduled payday, and neither I nor my coworker received our direct deposits. I emailed my consulting company this morning and was told they’re “not sure why the delay,” and that they’re “hoping payroll will process today.”
As of now, I still haven’t been paid. I have rent due Monday, so I’m starting to panic a bit because I’ve never had a missed payday before.
For context: • Payroll normally hits early in the morning • My coworker also didn’t get paid • My consulting company uses Paychex • The response I got felt vague and non-committal • I’m in Texas, if that matters legally
I’m trying to figure out:
What are my rights when a company misses payday?
Can I file a wage claim with TWC today, or do I need to wait?
Should I escalate this to the client (big tech company), or is that a bad idea?
Has anyone dealt with a payroll delay like this before?
I’m not trying to overreact, I just want to understand my options since this directly affects my ability to pay rent. Any advice or similar experiences are appreciated
