Ex Refuses To Leave. Do I Really Have No Choice But To Wait 30 Days In The State Of Texas.

Location: Texas

2 weeks after my ex and I called it quits she comes to

Me and tells me how she is going to be evicted and have nowhere to go. I was hesitant at first because we agreed that we were toxic together, but faltered because I did still care about her and she has a kid.

3 months later it has been constant arguments, and unable to agree on very simple things. This accumulated to an argument that ended with her throwing and breaking things around my apartment and punching and spitting on me. The cops were called (two female officers) and the best advice they could give is i have to give her at least 30 days and if i could leave since she had nowhere else to go.

After receiving that information I typed out a letter giving her 30 days to leave. This was yesterday which was also my birthday. When i came home to give her the letter she goes into the restroom and locks the door so i decide to wait until she was finished. I then had to sit there for and hour and a half and listen to her talk bad in every way about me, telling my secrets, and making plans to meet up with a guy i can only assume she was talking to before the argument. That was final straw for me and i want nothing more than to have her gone and have my own space again.

She has never paid rent nor a single bill here. She does receive mail here, which is why i was told she can legally stay, but in doing my research i see conflicting pieces of information saying i have to give her 30 days no matter what or because she hasnt paid rent a minimum of 3 days.
