Fil Died Without A Will And Cannot Figure Out What We Legally Can And Cannot Do With His Stuff. Specifically A Car And Zero-worth Items In The Apt.
Location: Virginia. FIL died. Lived in an apt. Owes creditors. Three child, but husband is the only one local/mentally capable of handling everything.
The stuff in his apt is not worth anything. We do not have space to store it, or the financial means to seek out legal advice. FIL didn’t have a will and put off important conversations. We are struggling to navigate. Can we toss/donate the stuff in his apt? Goodwill won’t take anything because it’s not in good condition. The complex wants the apt turned back over asap because rent wasn’t paid for December. The other children don’t have the means to get here or take anything. And we don’t have the funds to cover it.
FIL did have a car, and we aren’t sure what can and cannot be done with it. Do we sell it and put it into an account so if his creditors sue the estate it comes from that money? Nothing else is sellable. And he has the title to the car, but it’s not worth much.
We’ve already had to pay for the cremation up front, and we are tapped out. Thanks for any advice.
