Wife Is Pregnant With Another Man’s Child, Will This Make Filing For Divorce Much More Complicated?

Location: WA state. All parties.

My boyfriend has been separated from his ex (not legally though) for over 15 years. I understand people will think it’s very odd that he has not gotten a divorce in all this time, but I don’t want to get into the details of all of that to be honest, and regardless it’s not the point of my post anyway. They have a child together who turned 18 this week and he was planning on filing this month. He has been paying child support, but otherwise does not support her in any way and they have been filing their taxes and living separately since they broke up and they have no shared assets.

In WA state if it is an uncontested divorce you can file with Lincoln County and just mail in your papers and nobody has to appear in court. This was the original plan, but we just found out she is about 8 weeks pregnant by her boyfriend. I understand that the husband is presumed the father unless you take certain steps to change it.

Would an acknowledgement of parentage form be enough in this scenario? WA does allow divorce while the wife is pregnant, so I’m not worried about that. But how complicated could this make everything? Could he still do the “easy” mail in divorce so long as they file that form? Or does he now need a lawyer? I also don’t think she is going to try to get him for child support for this baby or anything, and will be fully compliant with getting the real father listed as the legal parent.
