Location: Upstate Ny, My Landlord Says Not Having Hot Water Isnt An Emergency

Location: Upstate NY I just moved into my new apartment with my family on 12/6, the following day 12/7 my wife attempted to take a bath and discovered it couldnt maintain hot water, I called the landlord in the morning 12/8 and maintenance was here that day, according to the two techs who showed up, the gas line going in was to small and couldnt keep up with the demand, they left after fixing another issue I reported and didnt see them the rest of the day, my wife once again attempted to take a bath and same issue, now flash to this morninf 12/9 I emailed the landlord asking if the maintenance team fixed it, or if a contractor had to come out and fix it, she said "its fixed" nothing else, so we get home (spent 4 hours in the ER as my wife and kids all caught a nasty case of the flu) I went to run the bath for them. I timed it, 1 minute 30 seconds of hot water and right back to cold, now there's no hot water anywhere in our apartment, I called the on call reporting the issue as in our last apartment just across town, when this happened it was classified as an emergency, according to this new team, its not...we live in Upstate NY, its currently below 10 degrees outside and snowing...correct me if im wrong, but isnt not having hot water classified as an emergency...trying to figure out my rights and grounds to fight this as my wife and kids deserve to be able to take a warm bath
