Passenger In A Car Accident — Other Driver Seemed Intoxicated, Wasn’t Tested, And I’m Injured. What Are My Options?

I (22F) was the passenger in a car accident this morning while riding with my coworker (21F) to work. She came to a full stop at a stop sign, and as she rolled forward, another car accelerated and T-boned us on the passenger side.

When the police arrived, the other driver appeared intoxicated (on drugs, not alcohol), but the officers didn’t make him go to the hospital and he declined any toxicology screening. He did not flee, but he refused medical evaluation and left after everything was taken down.

I went to the ER afterwards and have back pain, neck pain, and bruising. My coworker is also injured. We already missed work and may have to miss more.

I’ve never been in an accident before and have no idea how claims work. My questions are: • As the passenger, can I make an insurance claim for my injuries? • Can I file against my coworker’s insurance and the other driver’s? • Does the fact that the other driver appeared intoxicated (and declined a test) affect liability? • Since the police didn’t test him, does that limit the case? • Should I get a lawyer, and what type of lawyer should I look for? • Should I be talking to insurance companies myself or leave that to an attorney?

Any guidance on next steps or what to expect would be greatly appreciated. I’m overwhelmed and in pain, and I don’t want to make a mistake early in the process. Location: Harpers Ferry, West Virginia
