Appeals Court Rules Regime Can't Simply Boot Haitians, Including 45,000 In Massachusetts
A federal appeals court in Washington, DC last night upheld a ruling by a lower-court judge that the regime can't immediately revoke humanitarian visas for Haitians granted refuge here because of the awful, and ongoing, conditions in their homeland that have included hurricanes, earthquakes epidemics and the collapse of the government.
"[The] ruling is welcome news for Haitian families, our communities, and our economy," Gov. Healey said in a statement about one of the largest Haitian communities in the US. "Haitian TPS holders are nurses, home health aides, small business owners, teachers and caregivers. They are our neighbors, our coworkers and our friends. Massachusetts is proud to be home to a vibrant Haitian community, and we will continue to stand with them."
In a 2-1 ruling, the Court of Appeals for the District of Columbia denied the regime's request for a stay of an order by a DC District Court Judge last month to block a regime diktat telling Haitians to get out now, at least while their case remains in court. The majority said the regime simply failed to make a case why it was so damned important to suddenly boot large numbers of Haitians when it had not previously moved with any urgency to revoke their "Temporary Protected Status." And:
As the district court detailed at length, the termination of TPS would have "devastating" consequences for the plaintiffs, including risk of detention and deportation, separation from family members, and loss of work authorization.
The court noted a 2009 Supreme Court ruling that immigrants seeking to stay here could be deported before their cases are decided, but added that case was based on the assumption that should the immigrants be shipped out of the US, they would be allowed back in should they ultimately win their court cases.
Here, by contrast, the government has declined to represent that it would provide similar relief if the plaintiffs ultimately prevail in this litigation.
The regime could now appeal to the Supreme Court.
