Can Married Couples Choose Different Tax Regimes While Filing Itr? Itr Myth Busted

Many salaried couples believe they must choose the same tax regime while filing their Income Tax Returns, but that's a common misconception. Under Indian income tax laws, each individual is treated as a separate taxpayer and is free to choose the tax regime that best suits their financial situation.
This means one spouse can opt for the New Tax Regime to claim the Section 87A rebate if eligible, while the other can continue with the Old Tax Regime to claim deductions such as HRA, LTA and home loan benefits. Choosing different tax regimes does not lead to rejection of the ITR or trigger scrutiny simply because spouses made different choices.
However, taxpayers opting for the Old Tax Regime must file their ITR within the applicable due date. Missing the deadline could result in losing the option to choose the Old Tax Regime for that financial year. Before filing your return, compare your tax liability under both regimes and select the one that offers the maximum benefit based on your individual income and deductions.
