Man Hiding Under Child’s Bed Shot In Back Of Head

A mother comes home and finds a man hiding under her child’s bed at one in the morning.

That headline sounds like it writes itself.

Any parent hearing that immediately knows where their mind goes. A grown man in a child’s room, under the bed, after allegedly coming through the back door in the middle of the night — there is almost no innocent version of that story.

But then the facts get more complicated.

Police say the man was leaving the house. He and the mother went out to the front porch. A juvenile heard a gunshot. The man was found shot in the back of the head.

And now the mother, Kendra Scott, is facing first-degree murder and firearm charges.

This is where emotion and the law split apart.

If she found him under that bed and fired in that room, in that moment, we would be having a very different conversation. That does not mean there would be no investigation. It does not mean she would automatically walk. But legally, she would be standing on much firmer ground.

That is not what police say happened.

They say he was leaving.

He was outside.

He was facing away.

And unless new facts come out showing he turned around and presented an immediate deadly threat on that porch, the legal justification she may have had inside the house likely evaporated the moment he walked out the front door.

Because the standard is not whether he deserved it.

The standard is whether the threat was happening right now.

That is the part nobody wants to hear, especially when the emotion feels righteous.

I understand the rage. I understand the protective instinct. I understand why a mother finding a man hiding under her child’s bed would be operating at a level of fury most people cannot even imagine.

But the law does not care how angry you were.

It cares whether the threat was immediate.

And the cruelest part of this case is that she may have been trying to protect her daughter, but the one thing guaranteed to hurt that child for years is her mother sitting in a cell.

The gun control crowd will use this case to say a gun in the home turned a bad night into a body.

Miss me with that.

The gun did not make the decision on that porch.

She did.

But our side has to be honest too.

He had no business in that house.

And based on what has been reported so far, she may have had no business firing on that porch.

Both things can be true.

This is the part of self-defense nobody wants to talk about: surviving the threat is only the first fight. The second fight starts when the shooting stops, and it happens in court, where your emotions do not matter nearly as much as the facts.
