Ct Construction Company Owner Accused Of Not Providing Workers’ Compensation Insurance Coverage

A Connecticut construction company owner has been arrested for allegedly failing to provide workers’ compensation insurance coverage for his employees.

Carlos Gutama, 28, of Meriden was arrested Tuesday and charged with one count of noncompliance with insurance requirements, according to the state Division of Criminal Justice.

DCJ officials identified Gutama as one of the owners of C&D Gutama Construction, LLC, in Meriden.

According to the arrest warrant affidavit supporting the charges, authorities found that C&D Construction did not provide the required workers’ compensation insurance coverage for its employees when officials conducted a site visit on Feb. 22, 2024, at a worksite in Newington where the company been hired to install roofs on newly constructed apartment buildings. The joint visit was conducted by the Connecticut Department of Labor and investigators in the Workers’ Compensation Fraud Control Unit in the Office of the Chief State’s Attorney.

Authorities noted that state law requires businesses to demonstrate to the Workers’ Compensation Commission “their solvency and financial ability to compensate injured employees or beneficiaries.”

“Otherwise, the business must carry workers’ compensation insurance to cover the full liability,” DCJ officials wrote in a news release announcing the arrest.

Gutama is free on a $10,000 non-surety bond and is scheduled to appear in Meriden Superior Court next Wednesday. The charge he faces exposes him to as many as five years in prison and a fine of up to $5,000, DCJ officials said.
