[nv] Wedding Vendor Cancelled All Services After Receiving $5,500 Payment. Trying To Recover Money From Nevada Sole Proprietor. What Are My Legal Options?
I am looking for legal guidance regarding a wedding vendor based in location: Las Vegas, Nevada, that cancelled all future services after receiving payment for my wedding.
My fiancé and I entered into a contract with Ebony & Ivory Productions on June 1, 2026, for multiple wedding services scheduled for May 10, 2027, in Las Vegas, Nevada. The services included wedding photography/videography, content creation, wedding coordination, and hair and makeup services.
We made our payment on June 2, 2026, through Apple Pay using a Wells Fargo Visa debit card. The total amount paid was approximately $5,500.
On October 27, 2026, we received notice that the business was closing and that future services would be cancelled.
What the contract says:
There are two provisions that I believe are particularly relevant:
The postponement and cancellation policy states that if the company needs to cancel a booking for any reason, it will notify the client in writing and process a refund of all possible monies paid.
Another cancellation and forfeiture provision states that if the company fails to render the agreed-upon services or fails to secure the venue, it agrees to refund the client in full.
I have made multiple attempts to request a refund through email and text message, but have not received a refund.
The business registration issue:
I searched Nevada’s business records and found the following:
Transacting business name: Ebony & Ivory Productions
Entity name: Franchez Fleming
Entity type: Sole Proprietor
Entity status: Cancelled
Status change date: October 28, 2026
The person I communicated with identified herself to me as Tiffany Fleming, while the Nevada business registration lists Franchez Fleming. The registration appears to associate Franchez Fleming with the business as its sole proprietor.
My contract itself identifies only Ebony & Ivory Productions as the service provider, not Franchez Fleming personally.
What I have done so far:
Contacted Wells Fargo and filed a debit card transaction dispute. It was ultimately declined.
Attempted to dispute the payment through Apple Pay, which was also unsuccessful.
Sent a formal written demand for repayment to the business address and a separate copy addressed to the individual at a reported residential address.
Sent both letters through USPS Certified Mail, Return Receipt Requested.
Preserved my contract, payment documentation, cancellation notice, emails, texts, and mailing receipts.
My questions are:
Since the business is registered as a sole proprietorship, can I name Franchez Fleming individually, doing business as Ebony & Ivory Productions, in a small-claims lawsuit even though my contract only names the business?
Would Las Vegas Justice Court be the appropriate court? I researched both the business mailing address and the individual’s reported residential address, and both appear to fall within Las Vegas Township.
Does the fact that the Nevada business registration is now cancelled affect my ability to sue the individual owner for the money owed?
Is there anything else I should do before filing a small-claims case?
If I obtain a judgment but the individual files personal bankruptcy, what happens to my claim? Would I be considered an unsecured creditor?
Are there any potential legal risks associated with sending a demand letter to the owner’s reported residential address in addition to the business mailing address?
I am located in Virginia, but the vendor and the contract are connected to Nevada. I understand that I may need to pursue the claim in Nevada.
I am not trying to make unsupported accusations against the business or individual. I simply paid for contracted services that are no longer going to be provided, and I am trying to understand the proper legal process for recovering my money.
I would appreciate guidance from anyone familiar with Nevada small-claims procedure, sole proprietorships, or contract disputes. Thank you.
