(nyc)do I Have An Employment Case After Not My Requested Pto From 3+ Months Ago?

Ok so I’ve been working my at this security company for about 2 years as “part time” due to the fact that hours are not guaranteed cause of nightlife unless you know one of the account managers and they fuck with you.

For a while I was at this site in Brooklyn Williamsburg called The Refuge, was getting consistent hours 30+ from late October to mid February. I worked at other site, The Mirage(now known as Pacha) since my hiring and accrued 38 hrs of PTO over two years(I know the hours weren’t early there my first year).

Once I knew I was leaving for good, I requested my PTO from 5 shifts each over 10 hours. I called out in a span of 2 weeks and they said they’ll get back to me for approval. This was mid February, I haven’t received anything from them as well as since then I haven’t received one shift from them. I called them last week to see if they remembered but all they told me was they’ll look into it and give me a call back, and still no reply.

My question is do I have a case or should I js get my pto check and quit on the spot cause I’m still one of their employees despite not receiving anything shifts for over 3 months. Albeit I have a new job, and they are giving me overtime every week guaranteed as long as I don’t fuck it up so I doubt I can get any unemployment. I got the job right around early. February went through the process of orientation and then was going to put my two weeks in, but I got sick. This was Ramadan so I just called out and asked for PTO for those two weeks and still haven’t gotten a reply.
