(wy) Advice For Taking Best Buy To Small Claims Court For A Botched Order
Good afternoon,
I placed an in-store order for a graphics card and some other computer parts that totaled $2,400. The employee placing my order confirmed my address with me several times. I even provided my driver's license to make sure that the correct address was entered. After acknowledging that he had the correct address, I paid for my purchase and went on about my day.
Several days later, I receive a notification from the courier stating that my order was arriving in a day. I open the tracking number and notice that the delivery address is entirely wrong. I reside in Wyoming, but my order was being delivered to some random address in California. Initially, I believed the courier may have made a mistake. I call them and they advise me that Best Buy had provided them with the CA address.
I contacted Best Buy both over the phone and in-person. From those interactions, I learned that the employee may have, somehow, confused my address for the address of another customer when entering the shipping information. I further learn that I will not be receiving a refund until the all the parts of the order are returned to Best Buy. Of course, some random person in California is happy about their free RTX 5090 and I'm stuck footing the bill.
I'm kind of in a tough spot. From Best Buy's (Corporate) perspective, they delivered the correct product to the address that was (incorrectly) entered and I'm just a fraud who's trying to keep the product while also getting my money back. From my perspective, some random, probably overworked, employee made a clerical error on my order and I'm paying the price for it. I even asked that same employee in the store if he knew anything about the order, but he had entirely forgotten all the details and stated that he believed he entered the correct address.
Since customer service cannot remedy this issue, I considered disputing the purchase with my bank. However... I used Best Buy's rewards card to make the purchase, so I'm SOL on that front as well. I believe I only have two avenues left. I could fly to California, go to that address, and beg/hope/pray to get my products (highly unlikely and obviously silly.) OR I could take Best Buy to small claims court.
Any advice? Does my situation evoke a coherent, legally-sound argument?
Location: Wyoming, U.S.
