Airbnb Hosts Violating Hoa Rental Prohibiton
Location: Florida
I'm the president of the HOA in my neighborhood. Airbnbs are generally allowed in our neighborhood, with a few important caveats. First and foremost, no one may purchase a home and rent it within the first two years of ownership. We did this back in 2015 because hedge funds were buying up the houses in our neighborhood and were renting them out, pricing local residents out.
There is a home in our neighborhood that was purchased less than 2 years ago, and apparently it was purchased as an investment property, and a couple in Massachusetts have been running it as an airbnb. This is in clear violation of our rules. We sent a letter from our attorney and they apologized profusely, saying that they would immediately cease renting it, but they have continued to do so. we have had to file for pre-suit mediation, meanwhile they seem intent on running out the clock and delaying us in court.
My question is this: can we provide evidence to Airbnb that this host is violating our community rules and have them deplatformed? I tried reaching out to customer service but they wouldn't do anything. They said they just host the listings and that they wouldn't take it down. Is there anything I can do to get Airbnb to delist them?
