Apartment Charged Me Almost $4,000 Because A Furniture Delivery Truck Damaged The Gate After I Let Them In
Location: Arizona
I live in a gated apartment complex in Phoenix. I ordered a couch from a furniture store and they used their own delivery company to bring it.
The driver called me from outside the gate because he couldn't get in, so I opened it for him through the resident app. When he drove through, he turned too tight and hit part of the sliding gate with the truck. I didn't even know it happened until management contacted me.
They have security footage showing the delivery truck hitting it. A few days later they added $3,742 to my account for the repair.
Management says my lease makes me responsible for damage caused by guests or invitees, and because the driver was delivering something to me and I opened the gate, they consider him my invitee.
I contacted the furniture company and they said the apartment complex needs to file a claim directly with the delivery company. Management refuses and says their issue is with me, and I can go after the delivery company myself afterward.
They've now said the charge needs to be paid with my next month's balance. Can they actually hold me responsible for this just because I buzzed the delivery driver into the property?
