Asking Non-caregiving Adult Child To Move Out
Location: California I'm a 60 F who is a primary caregiver to my 95 yo dad for 5 years. I'm here almost all of the time staying with him and attending to him. I do all the work.
My 66 M sibling (only sibling) lives in the house but is like a roommate. He moved in 4 years ago to give his adult son's family a place to live.
He says hello and goodbye to our dad. He never engages him or me in conversation. He comes and goes as he pleases. I went on a 3 week vacation, my first in 5 years, and he put all my belongings in bags in the garage. He took over the bedroom/bathroom and garage. I've been sleeping on the couch and share a closet and dresser with our father now.
Would I get in legal trouble if I tell my brother to move out (there's an ADU in the back of his house) because he's not needed? I think this is inheritance related though the will says 50/50. We both have durable POA - medical and financial so I'm not too worried. I just want a bed to sleep in.
