Boss Missed Payroll Again And I Quit On The Spot. They Sent Me My Final Check And It's Incorrect.

My job missed payroll twice and on top of the other things I’ve already been putting up with, that was my final straw. I sent my resignation to my managers yesterday in the AM and said it was effective immediately. I asked for return instructions for the equipment and when I could expect my last (missed) check.

They reached out a few minutes into the morning asking to meet on zoom but I didn’t immediately reply. They had missed payroll and paid it 3 days late exactly a month ago and that's when I began job searching. I was shut out of the systems last night and they followed up through my personal email this morning to get on the phone/zoom. I didn't want to be too adversarial but knowing how they are, I wanted these things specifically in writing. I replied back saying I was tied up and that anything they wanted to discuss I was willing to do over email. I also asked again about when I could expect my final check and return instructions for the equipment.

They didn't respond but randomly paid me about 10% of what I'm owed for the semi-monthly period. I'm beyond pissed. For context, this is a startup that’s about to fall hard relatively soon so I’m just getting out before it tanks. I already documented the work I did this week because I anticipated something like this happening from the shady behavior I witnessed in the past.

I want to possibly file through the state but think my salary might be too high to qualify (50-90k). Is it worth consulting an attorney?
