Bought A Used Car From A Dealer With Clean Carfax — Now Flagged For Odometer Discrepancy Months Later. Do I Have A Case?
Location: Utah; I’m trying to figure out if I actually have a case here.
About 6 months ago I bought a used Toyota Sienna from a dealer in Utah. At the time, Carfax looked clean and the mileage seemed low. Nothing showed any odometer issues.
Recently, Carfax updated and now flags a possible odometer discrepancy. I also ran a paid vehicle history report, and it shows mileage inconsistencies from before the dealer I bought it from owned the car.
Some other details:
- I found that the odometer/dashboard in the car is only on higher trim levels, but this van isn’t that trim.
- The dealer left the odometer disclosure form blank (neither “actual mileage” nor “not actual mileage” checked).
- I took it to Toyota, and they found older service records showing higher mileage than what’s currently on the odometer. Toyota said they have no other way to verify mileage beyond their records.
- I gave all this to the Utah DMV. They said they couldn’t see anything showing the dealer knowingly did anything wrong, and the title looked clean when it was transferred.
- I have the California DMV doing an investigation now to see if they can find any additional records
Basically, the vehicle now has a history flag, the mileage doesn’t seem right, and its value is affected. Based on all this evidence I'm almost positive the odometer was swapped out. I’m thinking of hiring a lawyer — do I have a case?
