Breaking A Lease Early In California Due To Job Loss - What Are The Actual Legal Risks?
Location: california san diego
Hi everyone,
My family is currently renting a house in sd and our lease runs until March next year. (Around 4500-4700)
Unfortunately, my dad was recently laid off, and because of that we have to leave the U.S. (visa termination) and move back to home country within the next couple of months.
We simply can’t afford the rent anymore since his income has stopped. How tf we pay 4600 includes utility without any income.
We spoke with our landlord, and they said that if they find a new tenant, there shouldn’t be a problem. However, the current market rent for similar houses is around $4,500-$4,800/month, but he listed our house for $5,500/month, which seems much higher than the market rate.
Because of that, we’re worried that no one will rent it.
We’re considering moving out by the end of this month, leaving the house clean, returning the keys, and we’re even willing to give up our security deposit. We just can’t continue paying rent after we leave.
My questions are:
If we move out before the lease ends and return to home country, what are the realistic legal consequences?
Has anyone been in a similar situation where they left the U.S. after breaking a lease?
We’re not trying to avoid responsibility we’re just in a difficult financial situation after an unexpected job loss and want to understand what could realistically happen.
Thanks in advance for any advice.
