Brother Not Paying His Phone Bill, We Are On The Same Plan Under My Name

I 23f let my brother 20m on my phone plan September of 2024. Location: Virginia. Our dad kicked us off his, and my brother claimed that his mom couldn't take him on hers. I made it very clear from the start I wouldn't be paying for his line, and he was welcome to go elsewhere. I chose Verizon because it has the most coverage in my area.

He agreed and we went to the Verizon store. He got to pick everything out himself. We were doing the promotion where you get a free phone as long as you locked into the plan for 3 years. He chose is plan, and his phone. He chose a newer phone that was an extra $20 a month. His total came to $100 monthly. He signed a contract with Verizon, as did I. He was supposed to zelle me every month.

Here's the issue: Since he got on my plan he's never paid on time or in full. It wasnt as much of an issie, but in June of 2025 my girlfriend 24f also got on my plan. She became disabled shortly after moving in with me so I pay for her phone. I cannot afford to pay both. His line did go down to around $85 when she joined, and I let him know, but he still did not do anything. I have spoken to him at least 7 times since then, offering for him to do partial payments, but he would never do it.

In December I had a final talk with him and told him he needs to pay his phone off by January and get off our plan. He said fine. January rolls around, nothing. I message him and tell him by the end of the month. February 1st, nothing. So I text him that I am disappointed in him, and that he needs to pay the debt. At that point he owes me over $1300 in delinquent payments. I tell him to give the phone to me, and then I mark the phone as lost/missing and suspend the service.

Nothing. He finally gives me the phone the next day when I ask for it again but doesn't wipe it. He then I guess cried to mom that I kicked him off his plan and she put him on hers and bought him a new phone. I can't keep the service suspended and have to cut it back on by March. I'm now stuck with this phone that I can't really pay for. I'm trying to save to get my own place, as me and my girlfriend currently rent the unfinished side of the basement from mom.

The phone has $800 left and I can't afford t pay it off in full. The current plan is to force him to wipe it, pay it off asap then try to sell it. Is there anything I can do legally to try and recuperate any losses? Can I force him to uphold the contract he signed? He was 18, and the phone is in his name on the Verizon app, but its my credit on the line. What are my options?
