Can A Compnay Legally Charge Back Vacation Pay After You Retrun From Vacatuon And Put Your Two Week Notice In?
Location: MI. So heres the deal. The company is work for is currently on the slow walk to closing. When the company announced that the doors will be closing at the end of the year. We were all told to use the rest of your pto before the end becuase it wont be paid out. So when this was announced. I set a vacation over a month in advance for the reason stated above. Between the time of putting the vacation in and being accepted by hr and management. I begun searching for a job not expecting to truly find one and riding out the closure. 1 week before my vacation. I got a interview with one of the companies I was cherry picking and long story short. Walked out of the interview with an offer which I accepted later that week after confirming they would be fine waiting three weeks (1 for the vacation and 2 for 2 weeks notice) to which they accepted. So I go on vacation, come back the following week and give my 2 weeks notice, and work the first week of the 2 weeks as normal. Come today, I find out my check is missing 90% of the pay. Talk to hr and low and behold. They are claiming that becuase i found a job, they are not required to pay out my already taken pto time so did a charge back via this weeks paycheck which I see pending in my bank account.
I am assuming what they are doing is illegal. But I was looking for input of what others think or have been through before I make any moves.
