Can My Parents Take Legal Action Against A Group Home For Negligence? (massachusetts)
Location: Massachusetts
Hey everyone, looking for some legal advice regarding a pretty concerning situation involving my parents in Massachusetts.
Recently, a nonprofit organization purchased a house directly across the street from my parents and turned it into a residential group home for individuals with disabilities.
They’ve only been operating out of this house for approximately three weeks, and we’re already dealing with a situation like this.
One of the residents, who is a nonverbal adult, wandered over to my parents’ house. My mother answered the front door, and he pushed his way past her into the house without permission.
Once inside, he started wandering around the house, sitting on the couches, touching various belongings, and even attempting to go upstairs.
There were also two young children inside my parents’ house at the time.
Thankfully, nobody was hurt, but the situation could have gone very differently. My mother had no idea who this individual was or how he might react.
In another household, someone could have panicked or reacted defensively, potentially resulting in someone getting seriously hurt.
Here’s the part that concerns me the most.
When the police went over to the group home to investigate, the staff apparently had absolutely no idea that the resident had even left the property. They believed he was still inside his bedroom.
So not only did a resident leave the group home unsupervised, but the people responsible for his care reportedly didn’t even realize he was missing.
To me, that raises serious questions about the organization’s supervision and safety procedures, both for the residents themselves and for the surrounding neighborhood.
My parents no longer feel safe in their own home. They’re now worried about whether something like this could happen again, especially when their grandchildren are visiting.
Considering the organization has only been there for about three weeks, it’s concerning that something like this has already happened.
I want to make it clear that this has nothing to do with the residents having disabilities. My concern is that an organization responsible for supervising vulnerable individuals apparently didn’t even know one of them had left the building.
My parents are seriously considering taking legal action against the organization for negligence.
Are we actually justified in pursuing criminal charges or a civil lawsuit against the company for failing to supervise this resident? Or would we have no legal grounds since nobody was physically injured?
Thankfully, nobody was hurt, but I feel like this could have ended very badly for everyone involved.
Id appreciate any legal insight, especially from anyone familiar with Massachusetts law.
