Car Rear-ended, At-fault Driver's Insurance Insists We Go Through Our Own Insurance.
Location: Tallahassee, Florida. Another driver rear-ended our car. The police officer issued a ticket to the other driver.
We took our car to a body shop, and after they gave us an estimate of around $10,000, the at-fault driver's insurance said that the most they would pay was $10k, which also includes the rental we had to get while our car is in the shop. Our car is worth around $30k.
So that insurance company told the body shop to go through our insurance company instead. I didn't quite understand that this is what they were saying at first. My initial understanding was that they wanted our insurance company to cover anything over their limit.
So now our insurance wants a $1000 deductible, and they're only willing to cover $7000.
Since we're not at fault, I'm having trouble understanding why we'd have to pay anything, and I especially don't understand why an insurance company gets to decide they're not paying for something their insured is completely liable for. The entire situation is frustrating as hell.
Is this something they're actually legally able to do, or are they doing this just assuming that we'll go along with it because fighting with them is too much of a hassle?
