Caregiver Buyout Contract.
Location: Tennessee
I am a in home CNA in Tennessee. I have been some for almost 6 years now. To get to the point fast, my current client, who i have been with for nearly 2 years now, has mentioned to me in the past about my company attaching a buy out contract woth a fee of $20k if he ever wanted to hired me independent of my company.
With that in mind. I recently got a new job and have been working both jobs now for the past 3 weeks. The new job is in a completly different field. My plan was to completly leave the caregiver profession after this client passes. However, my agency is making it hard to keep both jobs. As they are not willing to be flexible at all with me, even though the client is willing. So I am probably leaving the company soon to focus on my new job.
I guess my question is, what do those contracts really entail and how enforceable are they? Like I said, I would be leaving the profession entirely. But alot of the things I did for this client were outside the scope of a caregiver, i.e handyman stuff and other general manual labor activities. So, what would a contract like that typically keep me from doing. Would it keep me from being at his home if I left the company at all? Or would it prevent me from doing labor for him. Or should it just prevent me from doing the specific labor tied to being a caregiver? I have asked him to sew the contract, but in his advanced age, he has become quite disorganized. We looked for it for a couple hours one day. And i am obviously apprehensive about asking my company to see the contract. And insight would be greatly appreciated. Thank you
