Consent During Labor?

Hello,

My bf and I are expecting our first child together. I am the type of person that has to have a plan in place for mostly everything. I understand that it doesn’t always work out, but it gives me peace of mind to have something to go on, should worst case scenario happen. Which brings us to my set of legal questions.

We are not married. So, I understand that he can’t consent to anything medically should I become incapable of making decisions. However, I looked into designating him as my medical proxy, so in the event something happens during labor, he is able to make decisions for me.

My question is: should something happen during labor and I am incapable of consenting to anything for the baby, would this extend to the baby being my designated medical proxy? Or is there something else that can be done, so he can legally consent.

From what I researched, I read that he can’t be legally the father unless he fills out an acknowledgment of paternity and/ or on the birth certificate and it is filed, which makes it difficult for him to consent to anything for the baby. Is that correct?

My main concern is that our baby will have a parent to consent for them in the event of an emergency.

Please advise!
