Constructive Eviction And An Infested Apartment

Location: Allentown PA.

My fiancé and I moved into an apartment at the start of August on our first day there, while cleaning we found a roach. I notified the landlord via text and he said “that’s weird, we haven’t seen anything lately.” Since then, we are seeing several a day/night. We have to keep our food in plastic containers because the cupboards in the kitchen are so bad.

I had an argument with the landlord and he initially said too bad pest control is the tenants responsibility on the lease but I’ve been looking online and it says that’s only the case if they are there after the first 30 days; they were clearly here before we came as I have never seen one at my old house.

We sent a physical letter titled “formal notice of unsanitary conditions, roach infestations, and demand for remediation” and requested an exterminator within 2 weeks. Today the landlord showed up himself and spread a substance called “crossfire” on the problem areas. I looked the stuff up and apparently it’s only for bedbugs.

My question is this: once the 14 days are up am I legally allowed to utilize constructive eviction to leave without penalty since the landlord decided to DIY fix instead of actually getting an exterminator? I don’t want to be on the hook for paying the rent and I don’t want to live here anymore.

My girlfriend is also disabled and immunocompromised if that matters. Thank you.
