Court Appointed Fiduciaries
Location: Connecticut
I have a couple questions concerning the fiduciary that was assigned to an estate I am sole heir to.
#1 - can the fiduciary recover a car and not inform me or my lawyer that he has recovered it, towing it to a undisclosed location accumulating storage fees and towing while putting in a status conference (the same day approximately ) to the court but not mentioning anything about the car instead adding a motion to sell the car 3 days before said hearing.
At the status conference, along with filing states the value of the car through KBB is $6000 and if I the sole heir sell the storage and towing will be waived. Upon asking how much the storage fees were fiduciary states idk but if you sell the car they’ll be waived.
I said no, the judge stated give me the car. The fiduciary released the car and I had to pay 3 weeks of storage and the tow and the tow out approximately $1600.
The fiduciary never went to the original site of the tow, never inventoried the car and never saw the car.
He stated the KBB on the car was $6000 using this number from the trade in screen on KBB. The median value was $6089 to $7114. He did not use the price of 10,625 as the private party value from KBB.
The car was originally towed to a xxxx auto sales but fiduciary stated it was at xxxx garage to the judge where it was in storage and xxxx garage would waive towing and fees if I were to sell the car.
The car was at a used auto sales dealership accumulating storage fees for 3 weeks. In an unsecured parking lot with no fence but buried in between cars for security.
Is this the norm? The estate has no debt so I’m not sure why he would sell the car without asking myself or my lawyer. He stated he didn’t know I did not want to sell the car is what he stated this at the status conference.
And what’s the correct KBB value? And how can a fiduciary create waste for an estate.
As of over 100 days plus the fiduciary had not submitted an inventory list. My lawyer put in a motion for removal but at the status conference he voluntarily resigned. He waited approximately 2 weeks to put a motion in to resign. Now his motion supersedes ours which now essentially backlogs us farther for a hearing while there is no inventory list.
