Cps Involvement For Child Who Has Not Been In My Custody In Over 10 Years.

I made a post on the sub yesterday with apparently all the wrong information due to no fault of my own, as another family was granted legal custody to my child when I was 17 during a period where I was in rehab for substance abuse, and I was given no paperwork or information to the child, only aware that they were not allowing me any contact with her as it has remained for the last 10 years.

With multiple children’s behavioral health unit placements and multiple referrals to CPS in the county where the legal custodians live they are now relinquishing their rights to this child and refusing to allow her back into their home.

The child is known to be aggressive and threatening to small children and authority Figures and I am not in a position to take placement of her as I have a five month old in the home, the child is currently in foster care as a residential behavioral placement isn’t an option due to her young age (11).

My parental rights remain intact and CPS has now been in contact with me and is stating that they will be making monthly home visits while the child is in foster care. There is a hearing next week regarding placement and child support obligations.

I’m waiting to receive a call back from a private lawyer, but I am understandably scared and unsure as to what my rights are as far as CPS involvement and letting them into my home as a new case was opened the day I brought my new baby home based on the removal of the prior child and it was closed after five months of home visits & court dates.

I am planning to pursue voluntarily terminating my rights with the child through my lawyer, but again, I am unsure of how much I need to comply with CPS as I believe it is court ordered since I am in the case plan as her biological mother.
