Dealership Is Demanding The Truck Back After Three Weeks But Already Sold My Trade-in
Location: Florida.
On May 15th, I bought a used truck from a local, well-known dealership. I traded in my old sedan, put down two thousand dollars in cash, and signed all the financing paperwork. I drove off the lot and have been using the truck for almost a month.
Yesterday afternoon the dealership called me and said the bank ultimately rejected my financing application. They told me I need to bring the truck back immediately or sign a new contract with a significanly higher interest rate.
I drove down there to just return the truck and cancel the whole deal. I handed them the keys and asked for my cash deposit back along with my old sedan. The finance manager laughed and told me they already sent my trade-in to an auciton house and it is gone. He said my cash deposit is non-refundable because I put "wear and tear" on the truck for the last three weeks.
Now I am sitting here with no vehicle and out two thousand dollars. The manager claims I signed a spot delivery agreement that protects them in this exact scenario. I read through my copies of the paperwork and I cannot find any document with that title.
Are they legally allowed to sell my trade-in before the financing is definetly finalized? What kind of lawyer do I even look for to sue a car dealership over this? I urgently need a vehicle to get to my job.
