Do I Have Legal Options To Break Lease?

Card image cap

Location: Michigan I am a tenant in an apartment complex in MI. Since about August of 2025 I have been dealing with constant severe and excessive noise disturbances coming from the unit above that have consistently disrupted my sleep, work from home AND downtime as the force of their running back and forth and screaming shakes my unit. I have been contacting my leasing office about the issue since January 2nd, to which they admitted to ignoring three emails from that date until February 13th when I called multiple times until I got a verbal response. They claimed several times to be taking action but made no follow-up calls or noted the actions taken until February 23rd where they claimed to have called the tenants with a warning. I met with a manager in person to provide video evidence and talk to a live person as the leasing office had screened my calls. On February 27th when we met, the manager stated that she would call again or post a notice on their door. The noise has not decreased or subsided in any way. Each time I requested a unit transfer, my inquiry was ignored or they hung up claiming to be planning a call back and then never calling. I have recently learned that a transfer would require a $1,000 fee and require regional management approval. I have strongly considered this option, however my leasing office has stated it wont be possible at this time and I also cannot break my lease as it does not end until September. Is there a legal way I can move out without incurring a balance for the rent missed? The noise has become unlivable, and I feel as though Im running out of options. (There is a clause in my lease that states that we are not as tenants meant to engage in activities that cause us to "behave in a loud or obnoxious manner; disturbing or threatening the rights, comfort, health, safety, or convenience of others in or near the apartment community." Quiet hours in my city are 10PM to 8AM.)
