Evict My Mom

Card image cap

My mother refuses to leave my house and I'm trying to figure out the appropriate steps of an eviction. She has a house in Puerto Rico that she refuses to live in because it needs a little work and she has told me she likes living here. She previously lent me 30k to fix my house when I bought it 5 years ago but with the economy changes and me taking care of my son, her and myself, I got into too much debt to pay her back. She used to pay $700 a month. She has her own bathroom and groceries, utilities, etc were never anything extra. I covered that. Since I couldn't pay her back, I told her she can stop paying rent and live here for free so she can save money to leave and retire which was always her plan. Its been a little over 2 years later and she still hasn't left. I asked her to pay $700 for the 6 months she was staying to then move out. 9 months later, she is still here and changed her plans. She wants to stay. I know I'll have to evict her. I've tried having several conversations with her and she just keeps saying that she has the right to stay because of the 30k loan even though we had a verbal agreement for her to stay for a year for free because I couldn't pay it back.

Can I get some guidance on thr next steps?

Should I hire a lawyer?

What's typically the costs for that?

My mom is also verbally abusive and we have had physical altercations in the past but I never filed a police report because she was a nanny and I didn't want her losing her job. She has cause 3 fires in my kitchen because she'll leave stuff on the stove and forget about it. She has broken several of my cabinets in my kitchen that was part of the remodel. She has damaged my wooden floors, damage the bathroom finishes, and broken my furniture. I have several projects around the house left unfinished because she won't let me work on them. I have a demanding sales job and my son is going in and out of depression. I'm currently in therapy and my cortisol is high due to stress which is affecting my health. My doctors and therapist are all recommending I evict her since she is a large stress factor.

I also want to add that the majority of the time that we have been living together, she has had my name on her bank accounts and loans because she didnt want to have bank accounts under her name or finance anything under her name.

Any advice would appreciated.
