Ex Filed Counter Ex Parte Against My Brother One Week After I Filed On Him. How Do Family Court Judges Handle This?

Card image cap

I recently filed an ex parte order against my ex for myself and our son. The filing was because he cornered me in a room, yelled at me while I repeatedly told him to leave me alone, called my job to tell them lies, and put our child in a dangerous situation. He has also physically assaulted me in the past (I have evidence ) My son and I moved into my parents house, where my brother lives, for the time being.

A week later, my ex filed a ex parte against my brother. In the paperwork, he claims my brother burned our son with a cigarette, threatened my brothers like life, harassed him for 12 years, and historically molested me and my cousin. None of this is true, and my son doesn't have any injuries.

He also said my brother assaulted him twice which the did get into a fight almost 10 years ago. I don’t know who started it.

We have text messages from late September showing my ex coordinating childcare and asking my dad to bring our son to my parents house. He has known my brother lives there for two years, but still let our child to the home just a few weeks ago.

The judge denied my ex parte but granted his.

So now I can’t stay with my parents when I have my child.

I have a lawyer who doesn’t seem bothered by this… said my brother and him are a completely separate case.

Can a judge see this as retaliation??
