Ex-spouse Won’t Pay Their Half Of A $6k Rental Debt Per Divorce Decree. If I Pay It All To Save My Credit, How Do I Get My Money Back?
Location: Ohio
My ex and I share a $6k debt from a rental home we lived in together. According to our divorce papers, this debt was supposed to be split 50/50. However, because we are both still technically liable to the collection agency/landlord, it’s hitting both of our credit scores.
My ex claims they are "completely broke" and can’t afford more than $100/month. I was almost willing to accept that until I saw them constantly at bars and they told me this week , the day after their birthday that they are going to be busy all week celebrating their birthday.
I’m tired of this hanging over my head and want to just pay the full $6,000 to clear the debt and protect my credit. My questions are:
If I pay the full amount, what is the best way to get the $3,000 they owe back? Is this a "contempt of court" issue since it violates the divorce decree, or do I have to sue them in small claims court? Does their spending (vacations/bars) matter in court if they are claiming financial hardship?
Should I even bother with an informal $100/month deal, or will that make it harder to legal enforce the full amount later?
