Family Suing Over House That Someone Else Paid For (texas) – Deed Was In Relatives’ Names
Posting for someone I know. Location: Texas, USA.
About 20+ years ago, this person was undocumented in the U.S. At the time he was afraid he couldn’t legally buy property, so when he purchased a house and land, the deed was put in the names of his niece and nephew (family members). However, he was the one who actually paid for everything — the down payment, the mortgage, property taxes, and all the maintenance and remodeling over the years. He has lived in the house since it was purchased.
Now more than 20 years later, those relatives are suing him and claiming the property belongs to them because their names are on the deed but not his. A court order has apparently told him to vacate the property.
The issue is that he paid for the entire property and invested a lot of money into improving it over the years. The relatives lived there for a few years (rent-free) and never contributed financially.
In a situation like this:
Does he have any legal arguments to claim ownership or compensation (for example, based on paying the mortgage and improvements)?
Does long-term occupancy (20+ years) matter legally?
Are there doctrines like constructive trust, unjust enrichment, or adverse possession that could apply?
Can the quiet title action apply in this case?
What kind of lawyer should he look for in Texas?
He is already trying to find a lawyer, but I wanted to understand generally what legal options might exist in a situation like this.
Any insight would be appreciated.
