Fired After Being Assaulted At Work
I was hired at an airport but I am still on probation.
Last week an employee who from what I've been told is a difficult one (crashed inside the airport didn't report, has gone off on other employees etc) and me got into an argument over the phone while on the job.
He came up to me a few minutes late, got in my face and pushed me. To be honest, I love this job . It's my dream job and the last thing I wanted to do was throw it away. I tried to calm him down and stepped back from him and he pushed me again while being directly in my face. Since we do manual labor and we have a lot of tools around us I was afraid he was going to escalate so I picked him up and put him down on the floor and walked away from him . He came after me and punched me in the face although I tried to duck I couldn't. After that I walked away since it was almost the end of the day. The next morning I asked my direct supervisor if I can speak to him and told him what happened . He said the other employee didn't come in because he said he was suffering from back pain from when I set him down on the floor. I was placed on suspension and I don't know what happened to him. I just received the call that I was let go because even though I was a victim of assault.
I love this job and even told them that I was willing to press charges against my coworker so they could see that I handled myself the best I could without getting a wrench thrown to the back of my head like I was afraid of happening.
I do know my supervisors went to bat for me and HR made the final decision from what I'm told. What are my options legally?
Location: Southern California.
