Grandpa Injured On Worksite. Paid Under The Table.

My grandpa was injured on a construction location, he was on a scaffold and fell off and broke his leg and back and is requiring surgery. The company did not have him in a harness or anything. When he fell he tried to walk and couldn’t and was yelling a little over an hour before they found him and didn’t call an ambulance but called my grandma and told her to come pick him up. They carried him to her car which probably made his injury worse. The company doesn’t have insurance so they can’t cover any of his medical bills. And my grandpa doesn’t have any medical insurance. They also won’t do the surgery without payment. And my grandma only lives off of disability which barely gets them by. The problem we are having is he is married to my grandma however they are the process of getting his papers and does have an immigration lawyer but you know how long that process usually takes. So he was paid under the table. Do we possibly have a case?
