Guardian Took My Settlement Money

Card image cap

Location: Guardian

I am now 26 but I still get calls from cash advance places which brings back up the memories of what has happened to me.

When I was 2 my mother died in a car accident along with other people in my family. I was in the car. My family decided to file a lawsuit against the truck that hit them and won. When I turned 18, I found out that my guardian sold all of the settlement money to insurance companies (such as peach tree) that would give her a lump sum now and take the rest. My guardian was scheduled to get a certain amount of money each month until I was 18 and I was suppose to get a lump sum when I turn 18 and another one at 21. The rest would be given to me in monthly payments until 25. But now I have nothing. The court documents said that my guardian could only use the money if in the best interest of me. Well I grew up poor and moved from house to house. Sometimes we were homeless. So I do not understand how she was able to sell all of the money and not just her portion for being my guardian. Is there anything I can do?

FYI guardian is now dead so I can’t sue her. I’ve spoken to attorneys and no one can give me an answer on what happened. They just say it shouldn’t have happened.

P.S. the original settlement was $500,000
