How Can I Legally Get A Mobile Home Removed From My Property?

Card image cap

Location:

I own land in South Carolina that my mother transferred to me. The deed is in my name.

Originally, my great-uncle owned the property and allowed his stepdaughter to live there for the rest of her life. She has since passed away. My great-uncle intended for the property to go to my mother, who eventually transferred it to me.

The stepdaughter’s granddaughter is the person I’ve been communicating with about removing the mobile home on the property. I’m not sure who legally owns the trailer.

They never paid rent. My mother’s only requirement was that they pay the property taxes while living there.

I sent the granddaughter written notice to vacate by a certain date. She agreed but later requested an extension, which I granted. Now that the extended deadline has passed, the trailer is still there.

She says she cannot move it because the title is missing and there is a lien on it. She claims she has to go through probate because there is no will or trust. She apologized for the delay but has not given me a timeline for removal.

**My questions are:**

● What legal steps can I take in South Carolina to have the mobile home removed? ● Do I need to go through Magistrates Court or contact the DMV first? ● Is a title absolutely required to move a mobile home if the title is lost or has a lien? ● Can I have the trailer legally removed through an abandoned or derelict mobile home process, or do I have to wait for probate? ● Does the fact that I own the land and the original occupant has passed away affect my options?

I want to handle this legally and do not want to claim ownership of someone else’s trailer. I simply want it removed from my property.

Has anyone dealt with something similar in South Carolina? I’d appreciate advice, especially from anyone familiar with SC property law.

Thank you!
