I'm Being Sued For A Credit Card Debt That Isn't Mine
Back in August, I got a letter from a law firm/debt collector about $12,000 credit card debt for a card I've never owned. I called the law firm and spoke to a woman who confirmed that I had the same first and last name as the debtor, but that my middle initial and date of birth were different. She said she would mark the case as fraudulent, and that I was all set.
Last Friday, I got served with a law suit from the same law firm/debt collector. The complaint indicates that most of their mail was sent to someone who lives in my city, but has a different address, different middle initial, and different date of birth.
How should I handle this? My gut says file an answer with the court and send a copy to the law firm as well, and include a cover letter that lets them know they've got the wrong person with an offer to send them redacted digital copies of identifying documents. If they decide to go to court, then get a lawyer?
