I’m Getting Sued For A Ridiculous Injury Settlement Following A Minor Accident And I’m Not Sure How To Proceed.
Location: Georgia
A few months ago (February) I was backing out of my apartment’s parking complex at no more than 5 mph and hit an idle vehicle sitting in the middle of the parking lot (I completely missed it in my rear view mirrors + camera and thought I had a clear route to back up, and the officer put me at fault (rightfully so), though this was also on private property). The incident was on video and the video was reviewed by the officer who responded prior to providing the accident information to me and the other driver.
About 2 weeks after this, my insurance contacts me and lets me know that I’m being sued for a $100,000 personal injury claim. The consensus I got from this conversation was not to stress it because situations like this are why insurance exists, so by this point I was waiting to see how it goes.
Fast forward to today, I’ve received an email with a copy of the claim and a long list of injuries related to the other guy’s lower back from my insurance. The email states that the claim is the policy limit, but that it’s possible I could have additional fees to cover if it exceeds. With this, there was a line stating that in the event that this goes to court, that they would hire attorneys to handle it, but also a line which mentions the option of hiring a personal attorney to review the case as well.
Should I be concerned? I don’t currently have a personal attorney and have never had to interact with one for any prior court stuff as they were just simple traffic tickets. Do I need to be ready to find an attorney to review this case?
More information that I’m not sure is exactly relevant, but related:
- The law firm is a contingency based law firm specializing in auto accident, workers compensation, and apartment shooting related personal injury claims.
- The law firm has no public reviews anywhere online and only a single court proceeding published.
- The other party tried to get me to pay him over $1000 at the time of the accident despite having no damage to his vehicle (all damage was to my rear bumper and tail-light).
Edit: the more information here is quite irrelevant. The consensus is that I should just let insurance handle it. Thank you to everyone who stopped by to help.
