I Was Denied A Job Because A Drug Test Showed My Prescribed Medications, Is This Legal?
Location: Colorado
I just had a drug screening for a job today and take 20mg of vyvanse (a type of amphetamine) for my ADD. I told my employer this as soon as I got to the building, and told the lady giving me the test before taking it. We wait and AMP obviously shows positive, but nothing else. I offered to come back tomorrow with my medication and not take it that day but they just shooed me out and wished me luck.
Edit: I’m sorry i didn’t supply a lot of info, i was a little scatterbrained as i wrote this after getting home. It was a full “We’re going to move on to other applicants. Wish you luck” kind of conclusion from then. My medication is mainly used to keep me focused on tasks and awake in the ams (the supposed shift was 5am to 10am). The job itself was for a desk position at a hospital, but it was under a private company. The worst side effects i get from my meds is a loss of appetite, which in my opinion and how i know myself, it wouldn’t impact my job. Lastly, I found an online pdf of their policies including the drug screening policy which said prescriptions are okay— which made me even more confused. If anybody needs more info i’ll answer in the comments, but hopefully this was enough?
