If My Employer Fires Me For Taking Medical Leave, Can I Collect Unemployment?
Location: Ohio
I work at a small nonprofit (currently about 6 employees). I am having a minor surgery in a few weeks. The procedure will be on my throat. They have been aware of this for a while and there is no clear policy on medical leave.
There is an event coming up less than 2 weeks after my surgery. While I expect to be on the mend mostly at this point, the event would require me to be speaking actively for approximately 5 hours with no one else staff wise in attendance if I need to stop or lose my voice. While recovery times vary, I highly doubt I'll be able to speak for 5 hours straight not even 2 weeks out.
I am taking my PTO for the first week, but they have been argumentative about me taking a second week of leave regardless of doctor clearance. I have PTO hours available (we do not have separate sick leave), and am prepared to take it unpaid if needed. They have declined to make any back up plan for the event and have told me that if I do not attend, I will not be fulfilling my job obligations and I may be terminated.
I know they are not bound to FMLA and we are an at will state, but if this happens, will I at least be eligible for unemployment?
