In Trouble With Property Manager For Having Sex In My Apartment At 3pm On A Weekday
Location: Montana.
I live in university owned housing but not dorms, it’s more for staff and family. For context, we are directed not to talk to neighbors we’re having problems with, but to call the office.
The people who live above me are professional upstairs neighbors. They usually make the most noise between 11pm-3am. Rolling things around, shouting and screaming, or watching tv/listing to music loudly. I’ve called and talked with the office many many times, but nothing has changed and I’ve been told the noise does not qualify as “disruptive noise”
I have a neighbor who lives below me. I’ve never had prior issues, and I try to be a considerate neighbor at all hours of the day (ie not stomping or heel walking, not playing music or watching tv loudly)
Recently I had someone over around 3pm on a weekday. We had sex, neither one of us were making obnoxious or loud vocalizations, but at one point the bed was rocking a bit and was making noise. My downstairs neighbor started banging on their ceiling/my floor.
More context, banging on the ceiling is prohibited in this housing complex. I’ve been told directly when reporting the people who live above me. We are told to report it when it happens. So I call the office, explain the situation including the sex part, and they say they’ll talk to them and call me later.
I never recieved any word back. But about 2 hours later after I woke up from a nap, a cop was at my door claiming I was reported for having loud screaming arguments. I literally woke up from a nap and played red dead. Not even fighting, I took Mary Linton to the theatre.
Eventually I get a call from the office saying I missed a conduct meeting, one I was never notified of. They apparently sent a letting on january 2nd to meet on January 5th, which I missed and have no email for.
Now I’m scheduled for a findings meeting because I missed this initial one, and it’s my last chance to tell my side of the story.
I’m just wondering what rights I have when it comes to having sex in my apartment. If they claim I’m violating the conduct code, do I have rights around enjoyment of space that I can lean on? I’m just so confused especially considering the amount of noise my upstairs neighbors make constantly and the lack of change regarding that.
