Is This Normal?
Location: ND
Forgive me, I'm not sure if this is the right place or flair.
I had a client I'm working with describe their experience in court. I just don't know if this is normal, and if there's anything that can or should be done about it.
Situation: My client (stepmom) shared that her stepdaughter (15) had a protective order filed against her mother due a domestic dispute that resulted in bruising on stepdaughter. Police took photos, agreed that the protective order should be filed, and were very helpful.
When in court, the judge was incredibly mean to stepdaughter. She wouldn't let dad help stepdaughter talk about what had happened. Condescendingly gave the 15 year old instructions on how to represent herself, present her evidence, call for witnesses, cross examine, along with a bunch of other legal jargon.
This 2 min legal education was extremely overwhelming.
When the 15 year old inevitably made a mistake the judge would criticize her like she was a seasoned lawyer. They brought evidence of the bruising but the 15 year old couldn't remember the exact date of events, right when asked, the judge didn't ask to see the photos. The 15 year old was visibly shaking out of fear, crying while talking, and on the verge of a panic attack the whole time.
On the flip side, she was very polite and patient with the mother.
Without giving much thought the judge then told the 15 year old the dispute was her fault, that parents have a right to do what her mom did to her, and denied the protective order.
What options does the family have in regards to action against the judge?
