Landlord Emailed Me That My Last Day Would Be April. 4th Because My Ex Husband Offered To Pay The Break Lease Fee. Didn’t Agree To This, Is It Legal?
Location: Oregon. I’m going through a divorce where I haven’t been formally living at the shared apartment in 2 months, but I am a co renter of the apartment. I still go back to get some things but haven’t been able to secure all my stuff there including legal and personal property. My ex husband has been trying to get me to sign a break lease, but I told him i wouldn’t do that with all my stuff being there.
He emailed our landlord and said I had abandoned the property in early January and the landlord called me to ask me if I would like to release my tenant rights. I explained the situation and how I was essentially homeless and couldn’t get my stuff yet. She confirmed that he cannot kick me off the lease unless both of us sign and agree. 2 days ago, I receive an email saying that my ex agreed to pay the break lease fee and the landlord said our last day will be April 4th. I didn’t consent or sign off on anything. I am an equal tenant on the lease. Is this in violation of my rights as a tenant? And what constitutes abandonment? I haven’t physically lived there but I went back to get some of my stuff throughout February. He has been paying the rent and the bills as this was our agreement before separation. I read our lease agreement and it says we can break our lease for a break free which he agreed to pay but doesn’t specify if only one tenant wants to do this. This is extremely stressful and what should I do? Do I have a case?
