Landlord Is Keeping Most Of Deposit Because Our Dog Barks

Location: Colorado

Landlord texted us and informed us today he would be keeping $1,000 of our deposit. The keys are missing and a couple of cabinet handles are popped out (he noted this). He said he is doing there repairs himself and cannot give us an itemized bill.

He said the main reason he is keeping 2/3 of the deposit is because he was going to evict us anyways because our dog barked too much.

During our time here he noted this, we made reasonable accommodations. Got our dog on anxiety medication, saw a trainer, hired sitters to walk him often, etc. He said we are lucky he did not end our lease early which would have forfeited our deposit. He said he feels $500 is a reasonable return because of the fact he has had to deal with the dog trouble. Mind you, our dog did no damage and again, we made reasonable accommodations to help.

Is this worth taking to small claims court? Is this something he can legally keep our deposit over? We understand some money kept for the replacement keys and the cabinet handles but we re-painted and everything.
