Landlord Wants To Break Lease After 1 Day.
We moved into a landlord owned townhome in location: Ashburn VA.
Upon moving in (toured once) from across the country, we started to notice some things. Mostly just some general filth in the kitchen, all 3 bathrooms, terribly dirty air filter, a dead mouse, and some cat poop.
In any other situation, we would just clean and replace what needed done. But our landlord has been less than nice/understanding with small red flags that we just didn't notice until now.
Today the landlord came by to do the move-in inspection together and I had my wife stay up stairs after how she was treated the day before. (General rudeness and yelling. We assumed it was a cultural difference.)
Once they arrived I let them know we had some issues, ie the above mentioned items. Further more that the home certainly was not cleaned as promised and was below the acceptable standard for us to even start unpacking our things.
I'm a new dad and my wife is quiet. Even though I hate confrontation, I know sometimes I'm going to have to have hard convos with people and not be pushed around for my families sake. All I was asking was for them to send professional cleaners to rectify the situation, and have the air filters changed as we are responsible for them but not Immediately upon move in.
Id like to note that anything I brought up during the initial tour was met with "I have many properties and can't be expected to do that" "I just bought this property and need it rented right away".
Moving forward, landlords boyfriend got very upset and defensive as I showed them all of the issues. Going so far as to blame me for moving in and expecting a clean home. I quickly shut him down as I dont know him and he is not on the lease. This was between me and my landlord.
Now for the advice part. They want to break this 12 month lease.. 1 day into it. I showed them the lease terms that I will not be paying to break it, and that we have done nothing to warrant eviction. We only ask for a clean space. Our lease agreement says if we were to want out for any reason we would be on the hook for the cost of all 12 months at $3250.
They stressed and yelled how they don't want a whole year of this and want us out they will give our money back ect. Saying "what if something happenes to the plumbing, we don't want you calling and asking us to pay for a plumber to fix it!" Are we allowed to ask for full moving vosts covered, full return of deposit and 1st months rent, as well as 3 months rent for stress of having to move Immediately? Considering if it was the other way around we would need to pay all 12 months.
